A running list of states and localities that require employers to disclose pay or pay ranges

Employers must disclose hourly or salary compensation, or a range of hourly or salary compensation, and a general description of all of the benefits and other compensation in all job postings, including but not limited to promotions.

A posted compensation range may extend from the lowest to the highest pay the employer in good faith believes it might pay for the particular job, depending on the circumstances. An employer may ultimately pay more or less than the posted range, if the posted range was the employer’s good-faith and reasonable estimate of the range of possible compensation at the time of the posting.

On June 5, 2023, Gov. Jared Polis signed SB 23-105, amending Colorado’s pay transparency law. Under SB 23-105, employers must notify all employees about each job opportunity on the same calendar day and prior to the date on which the employer makes a selection decision. Employers also must make reasonable efforts to inform employees about the name of the candidate selected for the job; the candidate’s new job title; information on how employees may demonstrate interest in similar future opportunities; and the selected candidate’s former job title, if that candidate was already employed by the employer.

If the employer is only physically located outside of Colorado and only has fewer than 15 employees working remotely in Colorado, the employer is only required to provide notice of remote job opportunities through July 1, 2029.
